生成式人工智能治理的范式跃迁与实践路径——从DeepSeek说起 被引量:5

摘要 生成式人工智能引发技术黑箱性、算法权力重构与模型自主演化三维治理危机,其具体表现为认知赤字、制度合法性危机及数字主权博弈。传统科层制治理模式因技术复杂度的指数级增长遭遇本体论失效,治理主客体间的认知鸿沟与技术-权力结构错配构成系统性风险根源。基于控制论哲学与制度理论交叉视角,提出“反馈-多样性-自指”三位一体的元治理架构:技术维度构建透明协议栈将可解释AI升级为国家数字基座,破解“隐私-透明”二元悖论;制度维度开发“法律-代码”双向编译器并依托监管沙盒实现动态合规;社会维度建立治理通证系统,借助哈伯格税制将对抗测试转化为共识调节工具。理论创新体现为三重突破:一是构建控制论契约范式,实现治理系统与技术系统的认知同构;二是创建三维嵌入模型,突破单层监管的路径依赖;三是开发风险分层治理工具箱,形成穿透式治理机制。实践层面建构“标准引领-主权捍卫-价值辐射”协同体系,基于“技术透明性制度敏捷性社会共识性”的递归循环机制实现治理逻辑的本体论嵌入,为全球生成式人工智能治理提供兼具理论深度与实操可行性的中国方案。 Generative artificial intelligence(GenAI)triggers a tripartite governance crisis encompassing technological opacity,algorithmic power redistribution,and autonomous model evolution,manifested through cognitive deficits,institutional legitimacy crises,and digital sovereignty contestations.Traditional bureaucratic governance models face ontological collapse due to exponential growth in technological complexity,with cognitive asymmetries and techno-power structural mismatches between governance subjects and objects constituting systemic risk sources.From a cybernetic philosophy and institutional theory interdisciplinary perspective,this study proposes a“feedback-diversity-self-reference”meta-governance architecture.Technologically,it constructs transparent protocol stacks to upgrade explainable AI as national digital infrastructure,resolving the“privacy-transparency”paradox.Institutionally,it develops legal-code bidirectional translators enabling dynamic compliance through regulatory sandboxes.Socially,it establishes governance token systems.By leveraging Harberger taxation mechanisms,it transforms adversarial testing into consensus coordination tools.Theoretical breakthroughs feature three innovations:A cybernetic contractual paradigm achieving cognitive isomorphism between governance and technical systems;A tri-dimensional embedded model transcending single-layer regulatory path dependence;A stratified risk governance toolkit enabling penetrative regulatory mechanisms.Practically,it constructs a“standards leadership-sovereignty safeguarding-value radiation”framework,embedding recursive“technological transparency institutional agility social consensus”mechanisms to ontologically reconstruct governance logic.This paradigm shift from risk prevention to digital civilization architecture offers a theoretically grounded and operationally actionable solution from China for global GenAI governance.
