数据要素是基础性资源和战略性资源,是赋能新质生产力发展的重要支撑。人民法院应充分发挥司法的引领、规范和保障作用,释放数据要素潜能,推动科技创新。数据资源案件技术事实和法律事实交织,且需要平衡多方利益,审理难度较大。因此,有必要强化数据资源案件的专业化审判,树立符合数据要素特点的现代化审判理念,设立专门审判机构,不断完善数据资源案件的裁判规则和审判配套机制,促进数据安全高效流通和产业健康有序发展,为推动数据要素赋能新质生产力发展提供有力司法保障。
Data elements,as foundational and strategic resources,serve as critical enablers for the development of new quality productive forces.People's Courts should fully leverage their guiding,regulating,and safeguarding roles to unleash the potential of data elements and drive technological innovation.Data resource cases often involve intertwined technical and legal facts,requiring the balancing of interests among multiple stakeholders,which complicates their adjudication.Consequently,it is imperative to enhance specialized adjudication of data resource cases by formulating modern adjudication philosophies aligned with the unique characteristics of data elements,establishing specialized tribunals,and refining the adjudicatory rules and supporting mechanisms.These measures will promote secure,efficient data circulation and healthy,orderly growth of related industries,thereby providing robust judicial safeguards for data elements to empower the advancement of new quality productive forces.
