摘要
立足广西环境资源审判改革现状,借鉴江苏、江西改革模式,对广西环境资源案件跨区域集中管辖进行研究。提出广西环境资源案件集中管辖改革,应从破解地方主客场、提高审判专业化为切入点,推进“地域+流域”的跨区域集中管辖模式;以铁路两级法院改革为依托,根据生态流域特点,构建具有“流域”性质的跨地级市集中管辖模式。同步实行“三审合一”审判模式,统一裁判尺度,破解执行难,跨区域集中管辖模式和案件审理模式共同推进,以破解环境司法的地方主客场现象,提高环境资源司法专业化,促进广西环境资源审判事业高质量发展。
Based on the reform situation of environmental resource trials in Guangxi and drawing on the reform models of Jiangsu and Jiangxi,this paper explores the relevant cases of cross-regional centralized jurisdiction in Guangxi.To advance the reform of centralized jurisdiction of environmental resource cases in Guangxi,we should address local protectionism,enhance professional adjudication,and promote the“territorial+river basin”cross-regional jurisdiction model.Relying on the reform of the two-tier railway court system and based on the ecological and river basin characteristics,we should establish a cross prefecture-level city centralized jurisdiction model with a“river basin”nature.Simultaneously,we are supposed to implement the“three-in-one”trial model,unify the judgment standards,and resolve the enforcement difficulties.Additionally,the cross-regional centralized jurisdiction and trial models of case should be jointly promoted to overcome the local favoritism in environmental justice,enhance judicial professionalism in environmental resource cases,and boost the high-quality development of Guangxi’s environmental resource trials.
