摘要
裁量基准的制度属性是档案主管部门自主解释性的行政规范性文件,在法理层面蕴含行政自制理论的控权逻辑,既有助于实现行政处罚的标准化适用,也有利于推动行政执法的公正合理。各级档案主管部门对裁量基准进行积极建构,在形式上表现为裁量基准表的分格技术,并呈现“情节细化+效果格化”的内在构造。尽管裁量基准取得一定成效,但实践中仍面临制度体系分散、解释技术相对粗疏、适用效果不足等难点。应遵循党管档案与档案治理现代化的理念要求,从系统制度的规则引领、解释技术的理性塑造、适用效果的管理监督上加以优化。
The institutional attribute of the discretionary benchmark is an administrative normative document interpreted independently by the archives management department,which contains the control logic of administrative autonomy theory at the legal level.It not only helps to achieve standardized application of administrative penalties,but also promotes the fairness and rationality of administrative law enforcement.The archives management departments at all levels actively explore the discretion benchmark,which is manifested in the form of the grid technology of the discretion benchmark table,and presents the internal structure of"plot refinement+effect grid".Although the discretionary benchmark has achieved certain results,it still faces difficulties in practice such as scattered institutional systems,relatively crude interpretation techniques,and insufficient applicability.We should follow the requirements of the Party's management of archives and modernization of archive governance,and optimize it from the guidance of system rules,rational shaping of explanatory technology,and management supervision of applicable effects.
