摘要
优化营商环境与完善商事破产制度息息相关,而个人破产的全国推广也被纳入立法考量中。当下,我国企业破产案件在处置中存在诸多问题,而个人破产案件的处置也存在实践困境。检察监督介入破产程序基于两方面的考虑:一方面具备相应的法律依据,符合经济效率原则以及具有矫正正义的意涵;另一方面有利于弥补维权途径的不足,联动各方主体保障程序顺利推进,把严破产案件的启动关口,以及有利于个人破产免责与复权制度的建立。检察监督可以在破产程序启动时、进行中与终结后三个阶段介入,对各方主体进行法律监督。检察监督介入破产程序的着力要点应是:加强破产制度的立法供给,完善与破产制度相关的配套制度,以及划定检察监督权力的界限。
Optimizing the business environment is closely related to the improvement of commercial bankruptcy,and the national promotion of individual bankruptcy is also included in the legislative consideration.At present,there are many practical dilemmas in the absence of procuratorial supervision and the implementation of individual bankruptcy in enterprise bankruptcy cases in China.Procuratorial supervision intervenes in bankruptcy procedures.On the one hand,it has a corresponding legal basis,reflects the value of economic benefits and contains the requirements of corrective justice.On the other hand,it is conducive to making up for the lack of rights protection channels,promoting the procedures by the collaboration of government and court,controlling the entry threshold for bankruptcy cases,and establishing an individual bankruptcy exemption system.Procuratorial supervision can intervene in three stages at the start of the bankruptcy procedure,in progress and after the end,and carry out legal supervision of all parties.Only by improving the legislative supply of the bankruptcy system,building a supporting system related to bankruptcy and delimiting the boundaries of procuratorial supervision power can the path of procuratorial supervision intervene in bankruptcy proceedings be improved.
