摘要
街头涂鸦与有限媒介间的权属分离催生规范适用的利益冲突,突出表现为著作权法与群体规约相抵牾、保护作品完整权与媒介物权相抵触。囿于规范外部性缺陷和媒介表达要素化,著作权法无法为此提供妥适的规则支持。通过发挥司法能动性将群体规约作为事实结构性要素引入裁判,同时从街头涂鸦的可移除性、街头涂鸦的艺术价值、涂鸦创作者的主观意图、媒介物权人的行为利益以及各方注意义务等角度开展要素权衡,是当前维系街头涂鸦艺术有序发展与实现社会精细化治理的必然选择。
The separation of ownership rights between street graffiti and limited media gives rise to conflicts of interest in normative application,and is notably manifested as tensions between copyright law and collective agreement as well as the clash between protection of the integrity rights of works and the property rights of media.Constrained by normative externalities and the elementization of media expression,copyright law fails to provide adequate rule support in this regard.It is the inevitable choice for the street graffiti to maintain the orderly development of graffiti art and to achieve nuanced social governance to introduce collective agreements as structural elements of case facts by leveraging judicial activism,and meanwhile to conduct factor balancing from perspectives such as the removable nature of street graffiti,its artistic value,the intentions of graffiti creators,the interests of media property owners,and the obligations of all parties.
