摘要
随着全球面临能源、环境、健康等挑战日益严峻,生物技术在大国竞争中占据重要地位,是推动国家科技进步和经济发展的关键因素,不仅可促进经济的可持续发展,也会提高社会福祉。但与此同时亦带来诸如生物安全、生物伦理等风险,给公私法益的保护带来诸多挑战。生物技术的发展与生物安全的保障需要统筹兼顾,如何在技术创新与生物安全之间重新寻找平衡,成为完善法律体系的关键。鉴于此,应通过特别法的形式对生物技术研发应用进行科学引导,文章从法律规范重构、立法观念转变、法律制度完善等多个维度阐释如何回应立法安排、规范体系的架构,以契合兼顾安全保障与创新激励的生物技术规制取向。
As the world is facing increasingly severe challenges in energy,environment and health,biotechnology has occupied an important position in the competition among global powers,and is a key factor in promoting national scien-tific and technological progress and economic development,which not only promotes sustainable economic develop-ment,but also strengthens social well-being.However,at the same time,it also brings many biosafety and bioethical risks,and poses many challenges to the protection of public and private legal interests.The development of biotechnol-ogy and the protection of biosafety need to be harmonized,and how to find a balance between technological innovation and biosafety has become the key to improving the legal system.In view of this,the application of biotechnology re-search and development should be scientifically guided through the form of special law.The article explains how to re-spond to the legislative arrangement and the structure of the normative system from the dimensions of reconstruction of legal norms,change of legislative concepts,and improvement of the legal system,in order to fit the orientation of bio-technology regulation that takes into account the safety guarantee and the incentives for innovation.
