摘要
网络犯罪高发使电子数据海量增长,抽样检验成为解决其证明难题的途径。抽样检验在行政调查和刑事证明领域逐步发展,进入电子数据领域的时机已然成熟,但仍存在法规标准尚不完善、抽检主体并未明确、抽检结果难以审查的弊病。基于此,应填补抽检法规标准漏洞,以司法解释或部门规范性文件形式加以细化,构建契合电子数据特性的技术标准体系;明确抽检主体选择,为其构建二元主体资格框架;审查抽检结果证明功能,从样本代表性和与其他证据综合认定事实两方面着手,确保结果准确反映整体情况。以期为刑事领域运用电子数据抽样检验提供参考。
The high incidence of cybercrimes has led to a massive increase in electronic data,and sampling inspection has become a way to solve the problem of its proof.Sampling inspection has gradually developed in the fields of administrative investigation and criminal proof,and the time is ripe for it to enter the field of electronic data.However,there are still drawbacks such as imperfect regulatory standards,unclear sampling inspection subjects,and difficulties in examining the sampling inspection results.Based on this,it is necessary to fill the loopholes in the regulatory standards for sampling inspection and refine them in the form of judicial interpretations or departmental regulatory documents,and construct a technical standard system that is in line with the characteristics of electronic data.It is necessary to clarify the selection of sampling inspection subjects and establish a dual subject qualification framework for them.It is also necessary to examine the evidential function of the sampling inspection results,starting from two aspects:the representativeness of the samples and the comprehensive determination of facts in combination with other evidence,so as to ensure that the results accurately reflect the overall situation.It is hoped that this can provide a reference for the application of sampling inspection of electronic data in the criminal field.
