摘要
作为重要的文化产品,数字音乐兼具文化和商品属性,其产业化水平在很大程度上影响着我国文化事业的繁荣发展。自国家版权局2015年发布“最严版权令”以来,数字音乐产业迎来了高速发展,全社会的音乐正版化意识有了很大提升,版权已经成为数字音乐规范、持续、健康发展的基础制度和关键保障。近十年来,我国数字音乐产业所面临的发展形势发生了巨大变化,人工智能、大数据、物联网等技术要素,以及传统文艺、民族元素、地域特色等文化要素,正深刻影响着音乐的创作、传播、使用与消费方式,进而不断推动行业结构朝着科技化、差异化、精品化和多元化等方向发展。与此同时,我国数字音乐产业依然存在规模效应不强、发展质量不高、版权价值被低估以及新技术发展带来的各种问题。着眼于追赶发达国家市场水平、文化强国建设等中长期发展目标,全面严格的版权保护依然重要,高效便捷的版权运用势在必行,通过文化消费提升版权价值才能行稳致远。本文旨在新的发展形势下,对我国数字音乐版权产业进行系统性思考,为推动数字音乐高质量发展,释放数字音乐新质生产力建言献策。
As an important cultural product,digital music has both cultural and commercial attributes,and its level of industrialization largely affects the prosperity and development of China’s cultural undertakings.Since the National Copyright Administration issued the“strictest copyright order”,the digital music industry has achieved high-speed development,and the awareness of music legalization throughout society has been greatly enhanced.Copyright has become the basic system and key guarantee for the standardized,continuous,and healthy development of digital music.Over the past decade,the development situation of China’s digital music industry has undergone tremendous changes.Technological factors such as artificial intelligence,big data,and the Internet of Things,as well as cultural factors such as traditional art,national elements,and regional characteristics,are profoundly affecting the creation,dissemination,use,and consumption of music,and are continuously driving the industry structure to develop in the directions of technologization,differentiation,refinement,and diversification.At the same time,China’s digital music industry still faces problems such as weak scale effect,low development quality,undervalued copyright value,and various issues brought about by the development of new technologies.With an eye on the medium and long-term development goals of catching up with the level of developed country markets and building a strong cultural country,comprehensive and strict copyright protection remains important,and efficient and convenient copyright utilization is imperative.Only by enhancing copyright value through cultural consumption can we achieve long-term stability and development.This paper aims to systematically explore China’s digital music copyright industry under the new development situation and offer suggestions to promote the high-quality development of digital music and unleash the new productive forces of digital music.
