摘要
近期,歌曲《年轮》引发的“原唱”归属争议,暴露了我国著作权法体系下“原唱”概念法律地位缺失与认定逻辑混乱的现实困境。音乐作品中词曲作者的著作权与演唱者的表演者权之间存在法律分野与不同权利位阶。“原唱”作为行业惯例称谓,其法律身份本质上仍是表演者,不享有超越词曲作者的权利。“原唱”认定虽无法律意义,但其承载的市场价值与引发的现实纠纷,催生了法律回应的迫切需求。在此基础上,从首次发表原则、创作意图与合作作品理论、合同约定等维度构建“原唱”认定的法理基础是可行思路。借鉴域外经验与行业实践,通过以“强化合同约定与推广示范条款、完善著作权登记与集体管理、明确司法认定标准”为核心的“三位一体”方案,实现音乐作品“原唱”的依法清晰认定,更好平衡各方利益,促进音乐产业健康发展。
Recently,the dispute over the ownership of the"original singer"triggered by the song Nianlun has exposed the practical predicament of the lack of legal status of the concept of"original singer"and the confusion in its identification logic under China's Copyright Law system.There exists a legal division and different right hierarchies between the copyright of lyricists and composers of musical works and the performer’s right of singers.As a customary term in the industry,the"original singer"is essentially a performer in legal identity and does not enjoy rights superior to those of lyricists and composers.Although the identification of"original singer"has no legal significance,the market value it carries and the practical disputes it triggers have given rise to an urgent need for legal response.On this basis,it is a feasible approach to construct the jurisprudential basis for identifying"original singer"from such dimensions as the principle of first publication,creative intent,the theory of collaborative works,and contractual agreements.Drawing on foreign experiences and industry practices,a"trinity"scheme centered on"strengthening contractual agreements and promoting model clauses",improving copyright registration and collective management,and clarifying judicial identification standards can realize the clear identification of the"original singer"of musical works in accordance with the law,better balance the interests of all parties,and promote the healthy development of the music industry.
