摘要
“数据二十条”倡导的数据要素收益分配制度体系可以从时代价值、分配体制和分配机制三个方面展开。数据要素收益分配制度体系开拓了数字经济时代分配正义的新视野,具有方向性、必要性和可能性的特征。为此,可以从明确政府参与数据要素收益分配的各项权利、健全数字企业获取数据要素收益路径、完善数字劳动者的数据利益保障方案等三个方面对数据要素收益分配体制内容进行完善和创新。同时,通过引导机制、市场机制、推进机制、诉请机制的构建可以为数据要素收益分配的实现提供制度保障机制,让数据红利更多、更公平地造福全体人民。
The income distribution system of data elements advocated by the"Data Articles 20"can be developed from three aspects:its contemporary value,distribution system and distribution mechanism.The income distribution system of data elements opens up a new vision of distributive justice in the era of the digital economy,with the characteristics of directionality,necessity,and possibility.To this end,we can improve and innovate the content of data elements income distribution system from three aspects:clarifying the rights of the government to participate in the income distribution of data elements,improving the path for digital enterprises to obtain the income of data elements,and perfecting the programme for safeguarding the data interests of digital workers.At the same time,the construction of guidance mechanisms,market mechanisms,promotion mechanisms and appeal mechanisms can provide institutional safeguards for the realization of the income distribution of data elements,so that the data dividend can benefit all people in a greater and fairer way.
