摘要
随着公共政策在各个领域的全面推广,司法理应对其作出回应。法院执行公共政策具有理论应然性,并遵循着“自上而下”的创制和“由下而上”的实施两种动态运行逻辑。与此同时,公共政策在司法适用过程中并非一蹴而就,应防范个体利益保护失衡、裁判不确定性增加等司法风险,需要在运行机制、利益分配、实施裁判三个层面加以调适,形成上下贯通的互动机制,实现对公共利益与个体权益的双重保障,并对裁判过程中法院执行公共政策的限度加以明确,提高裁判过程中的规范性,最终实现司法过程中法律效果和社会效果的统一。
With the comprehensive promotion of the public policy in various fields,the judiciary should respond to it.The court’s execution of public policies has theoretical necessity and follows two dynamic operating logics:top-down creation and bottom-up implementation.At the same time,public policies in the judicial application process are not achieved overnight.It is necessary to prevent the judicial risks such as imbalanced protection of individual interests and increased judicial uncertainty.Adjustments need to be made at the three levels of operation mechanism,interest distribution,and implementation of judgments,forming an interactive mechanism that connects the upper and lower levels,realizing the dual protection of public interests and individual rights,and clarifying the limits of the court’s execution of public policies in the judgment process,improving the standardization of the judgment process,and ultimately achieving the unity of legal and social effects in the judicial process.
