摘要
研究目的:在乡村振兴背景下,探索农村宅基地退出和盘活“村村挂钩”模式的实践经验和运行机制。研究方法:案例分析法、比较分析法。研究结果:聚焦宅基地制度改革试点地区关于“村村挂钩”的探索,将其宅基地退出与盘活模式归纳为原址腾退、空间置换和指标漂移三种。“村村挂钩”探索具有整合土地资源,完善乡村产业用地制度、保障农民权益,完善乡村基层治理体系、推动乡村重构,实现跨区域要素流动的现实价值。研究结论:“村村挂钩”实践的后续推广应注重制度体系规范性、运行底线明确性和配套支持完善性,未来我国宅基地制度改革的关键仍在于通过宅基地退出与盘活机制的完善,有效实现宅基地所有权、资格权和使用权权能,建立城乡平等的土地制度,为乡村争取更多发展机会。
The purpose of this study is to explore the practical experience and operational mechanism of"plus and minus linkage with rural construction land"for rural residential land withdrawal and redevelopment in the context of rural revitalization.The research methods include case analysis and comparative analysis.The research results are as follows.Focusing on the exploration of"plus and minus linkage with rural construction land"in the pilot areas for rural residential land institution reform,withdrawal and redevelopment models of rural residential land are summarized into three types:on-site relocation mode,space permutation mode and indicator drift mode.The policy of"plus and minus linkage with rural construction land"can explore the integration of land resources and improve rural industrial land system,protect the rights and interests of farmers,improve the grassroots governance system in rural areas,promote rural reconstruction and realize the practical value of cross regional factor flow.In conclusion,the follow-up promotion of"plus and minus linkage with rural construction land"should focus on the standardization of the institutional system,the clarity of the operation bottom line,and the improvement of supporting facilities.The key to the reform of rural residential land institution in China in the future still lies in improving the mechanism for rural residential land withdrawal and redevelopment,effectively realizing the ownership,qualification and use rights of rural residential land,establishing an equal land institution between urban and rural areas,and striving for more development opportunities for rural areas.
