摘要
自然资源统一确权登记制度发轫于外部的生态文明体制改革与内部的资源资产产权化改革的交互作用,是我国综合性产权制度体系改革的前端。现有研究针对自然资源统一确权登记的法律属性、登记范围以及与不动产登记的关联关系进行了一定程度的探究。其中,法律属性被界定为行政性摸底登记、资产性管理登记抑或物权性产权登记;登记范围被锚定为“全域”抑或“全要素”自然资源;与不动产登记的关联关系被框定为包含、交叉抑或独立且并行。目前,学界已就部分观点达成共识,但仍存在观念与实践脱节、学理研究深度不够等未竟之处。未来,应充分考量“生态保护”与“产权保护”的双重改革目标,厘清自然资源之上“经济物”与“生态物”形态之间的分野与叠合,注重实践考察以及域外经验借鉴,从而裨益自然资源统一确权登记制度的完善。
The natural resource unified registration system originated from the interaction between external ecological civilization system reform and internal asset-based property reform,and is the front end of China's comprehensive property rights system reform.Existing studies have explored to some extent the legal attributes,registration scope,and relationship with real estate registration of natural resource unified registration.Among them,the legal attributes are defined as administrative survey registration,asset management registration,or property rights registration;the registration scope is anchored as“the whole territory”or“all elements”of natural resources;and the relationship with real estate registration is defined as including,intersecting,or independent and parallel.Currently,some views have been reached in the academic community,but there are still some unfinished issues such as the gap between concepts and practice,insufficient theoretical research,etc.In the future,we should fully consider the dual reform goals of“ecological protection”and“property rights protection”,clarify the division and convergence of the“economic objects”and“ecological objects”of natural resources,pay attention to practical investigation and foreign experience reference,so as to benefit the improvement of the natural resource unified registration system.
