摘要
通过对《联合国海洋法公约》等国际公约或条约赋予的沿海国在专属经济区内船舶污染管辖权进行解读,指出这些公约的规定并不全面且对沿海国存在诸多限制。针对我国海事管理机构对专属经济区内船舶污染执法管辖现状,分析存在的问题,提出应在管辖范围、执法程序、执法力量及国际合作上着手,完善我国海事管理机构在专属经济区内对船舶污染的执法管辖。
Based on the interpretation of the jurisdiction of the coastal state with regard to the protection and preservation of the marine environment in the exclusive economic zone as provided by international conventions or treaties including the United Nations Convention on the Law of the Sea,this paper indicates that such provisions are not comprehensive with many restrictions on the coastal state.In view of the current conditions of the law enforcement jurisdiction over ship pollution by the maritime administration of China in its exclusive economic zones,the paper studies the existing problems and suggests that emphasis be put on the jurisdictional scope,law enforcement procedure,law enforcement forces and international cooperation,aiming to improve the law enforcement jurisdiction of the maritime administration of China over ship pollution within its exclusive economic zones.
