摘要我国《文化产业促进法》孕育于行政法、经济法等传统部门法的土壤中,随着文化社会关系的发展又承载着托举文化法作为独立领域法建设发展的使命,是促进文化产业高质量发展的文化基础法。《文化产业促进法》在促进文化权利保障、社会主义核心价值弘扬、文化产业高质量发展等方面具有重要的价值和作用。当前,加快推进我国《文化产业促进法》的出台,关键是在明确其法律性质、价值和原则的前提下,立足我国文化产业发展实际情况和需求,回应文化强国和法治中国建设的现实要求,从优化文化产业高质量发展生态、夯实文化产业高质量发展基础、增进文化产业高质量发展动力、提升文化产业高质量发展活力等维度,厘清法律制度建构的重点内容和现实面向。 China’s Cultural Industry Promotion Law was conceived in the soil of traditional branch laws such as administrative law and economic law,and with the development of cultural and social relations,it carries the mission of promoting cultural law as an independent field law,and is a cultural basic law to promote the high-quality development of cultural industry.The Cultural Industry Promotion Law has important values and functions in promoting the protection of cultural rights,the promotion of socialist core values,and the high-quality development of cultural industries.At present,the key to accelerate the introduction of China’s Cultural Industry Promotion Law is to base on the actual situation and needs of the development of China’s cultural industry,and respond to the realistic requirements of the construction of a strong cultural country and the rule of law in China under the premise of clarifying its legal nature,value and principles.From the dimensions of optimizing the ecology of high-quality development of the cultural industry,consolidating the foundation of high-quality development of the cultural industry,enhancing the momentum of high-quality development of the cultural industry,and enhancing the vitality of high-quality development of the cultural industry,the key contents and realistic aspects of the construction of the legal system are clarified.
