摘要
全过程人民民主概念的提出与《信访工作条例》的印发重新激活了对信访制度属性定位的讨论。信访制度兼具政治、行政与治理三种属性,其发端于党的群众路线的特点表明,信访制度的本质是中国共产党主导创建的独特民主制度,也决定了政治属性是信访制度的第一属性,而民主则是贯通信访制度政治、行政与治理三种属性的核心价值。全过程人民民主是由多种民主组成的大规模矩阵。作为全过程人民民主构成要素的信访制度因自身蕴含草根民主、直接民主等成分,成为了全过程人民民主的次级矩阵。而信访制度作为标准制度接口的广泛嵌入、独特的民意吸纳方式,以及内置的动力机制等优势,使自身成为了发展全过程人民民主的一条隐微路径。信访制度通过对民意的识别、对少数民意的保护,以及不制造民意的对立,为全过程人民民主超越西式代议制民主乃至民主的内在局限提供了积极探索。
The introduction of the concept of“whole-process people’s democracy”and the issuance of the“Regulations on Petitioning”have started discussion on the nature and positioning of the petition system.The petition system,which combines political,administrative,and governance attributes,originated from the mass line of the Communist Party of China.The origin indicates that the essence of the petition system lies in the unique democratic system led and created by the CPC,and it also determines the primary attribute being political,with democracy serving as the core value that connects the political,administrative,and governance aspects of the system.Whole-process people’s democracy is a large-scale whole composed of various forms of democracy.The petition system,an element of this democracy,contains components like grassroots democracy and direct democracy,making it a secondary one within the broader framework of whole-process People’s Democracy.Additionally,the petition system’s advantages like widespread integration,the unique methods of receiving public opinion,and the built-in dynamic mechanisms make it a subtle way for developing whole-process people’s s democracy.Through identifying public opinions,protecting minority opinions,and avoiding the opposition in public sentiment,the petition system provides an active exploration for the whole-process people’s democracy to overcome the inherent limitations of the representative democracy in the west and democracy in general.
