摘要
作为推进区域协调发展的重要举措和法治路径,区域协同立法对于推动地方立法和国家治理现代化有着重要的制度功能与深远意义。实践中,区域协同立法亦面临诸多合作难题和功能实现困境。这主要表现为,区域内经济社会发展事实上的不平等使得立法共识难以达成,整体主义的区域立法与局部主义的地方保护之间的冲突难以调和,区域内部促成协同立法的内在驱动力严重不足。为进一步激发区域协同立法的内在动力、达成各方协同立法的意愿,务必确立公平公正、协商一致、互利共赢的立法理念和原则,激发地方立法机关的自主性和积极性,加强中央立法机关的顶层设计和统一指导作用,并以健全的区域协同立法制度体系和常态化工作机制推动区域协同立法各项功能更好实现。
As an important measure and legal path to promote regional collaborative development,regional collaborative legislation has important institutional functions and profound significance in promoting the modernization of local legislation and national governance.In practice,regional collaborative legislation also faces many difficulties in cooperation and functional realization,which are mainly manifested as follows:the factual inequality in economic and social development within the region makes it difficult to reach legislative consensus,and the conflicts between holism-based regional legislation and locality-based local protection are difficult to reconcile,and the internal driving force for promoting collaborative legislation within the region is seriously insufficient.In order to further stimulate the internal driving force of regional collaborative legislation and achieve the willingness of all parties of collaborative legislation,it is imperative to establish a legislative concept and principle of fairness,impartiality,negotiated consensus,and mutual benefits,stimulate the autonomy and enthusiasm of local legislative organs,strengthen the role of the central legislative organs in top-level design and unified guidance,and promote the better realization of various functions of regional collaborative legislation through a sound regional collaborative legislation system and regularized operational mechanism.
