摘要
欺诈作为侵犯消费者权益的行为,普遍存在于网络购物中。由于《消费者权益保护法》对欺诈未形成明确定义,司法裁判中对电商平台欺诈认定时广泛适用《中华人民共和国民法通则》第68条或以此为基础的“四要件说”,加重消费者的举证责任,背离了《消费者权益保护法》的立法目的。认定电商平台欺诈应当以《消费者权益保护法》为基础,适用欺诈方欺诈行为、主观故意及被欺诈方因错误产生意思表示构成的“三要件”说,严格区分自营业务与非自营业务,主观故意采用过错推定原则,将错误认识与意思表示间的因果关系通过案件证据和事实予以认定并作为赔偿责任的影响因素予以考虑。
As an infringement of consumer rights and interests,fraud generally exists in online shopping.Due to the lack of a clear definition of fraud in The Law on Protection of the Rights and Interests of Consumer,the 68th item of Article of the People’s Opinions or the“four elements theory”based on it are widely applied to the identification of fraud on e-commerce platforms in judicial decisions,increasing the burden of proof on consumers and deviating from the legislative purpose of The law on Protection of the Rights and Interests of Consumer.The identification of e-commerce platform fraud should be based on The Law on the Protection of the Rights and Interests f the Consumers,apply the“three elements”of the fraudulent party’s fraudulent behavior,subjective intent and the fraudulent party’s expression of intention due to error constitute fraud,strictly distinguish self-operated business from non-self-operated business,and adopt the principle of fault presumption subjectively and intentionally.The causal relationship between fraud and wrong understanding is determined by case evidence and facts and considered as the influencing factors of compensation liability.
