摘要
高校学位论文是具有较高学术价值的研究成果,其开发利用有助于学术资源开放流通、提高科学知识的可及性,并可起到公众监督的作用。我国法律对学位论文开发缺乏直接规定,学位论文授权书是开发利用的主要依据。考察42所一流高校的学位论文授权书发现,主要存在以下问题:一是权利归属约定不合理,与我国《著作权法》规定相左。二是授权书遗漏许可合同必需要件、授权语言模糊不清。三是商业性利用条款存在效力瑕疵。基于以上问题,高校应当坚持公益引领、合规致远:在拟定学位论文授权书时明确论文作者权利人身份、明晰授权源头;授权书应当全面覆盖所需的权利种类,明确约定许可使用的地域、期间和报酬;并区隔公益性使用与商业性使用,遵循自愿原则推动学位论文商业性开发。
Theses and thesis/dissertations in universities are research results with high academic value,and their utilization can help the circulation of academic resources,improve the accessibility of scientific knowledge,and contribute to the establishment of a public supervision system.There is an absence of direct regulations in our legal framework regarding on the utilization of theses and thesis/dissertations,and the copyright authorization for theses and thesis/dissertations is the main basis for utilization.The following problems exist in the copyright authorization for theses and thesis/dissertations of 42 first⁃class universities:first,the agreement on the attribution of rights is unreasonable and contradicts the provisions of Chinas Copyright Law;second,the copyright authorization for theses and thesis/dissertations omits the necessary elements of the license contract and the expression used in copyright authorization for theses and thesis/dissertations is vague;third,the validity of the clause for commercial use is defective.Based on the above problems,universities should insist on leading the utilization of theses and thesis/dissertations with public welfare and commencing compliance work before further utilization:when drafting the copyright authorization for theses and thesis/dissertations,the identity of the author and the source of authorization should be clearly clarified;the copyright authorization for theses and thesis/dissertations should comprehensively cover the types of rights in need and clearly agree on the field,period and remuneration of the license;it should also separate the public welfare use from the commercial use,and follow the voluntary principle to promote the commercial use of theses and thesis/dissertations.
