摘要
随着数字经济的全球化发展,数字人民币在跨境支付场景下的潜力逐渐显现,但随之而来的法律风险与法律冲突也日益凸显。《通用数据保护条例》(GDPR)作为全球最严格的数据保护法律之一,对数据跨境流动提出了极高的合规要求。GDPR的核心原则和数据主体权利保护规则与数字人民币的技术特性及“可控匿名”机制存在一定冲突,不同司法管辖区带来的监管不确定性也给数字人民币跨境支付数据合规带来挑战。对此可以从规则细化与制度构建、技术创新平衡数据保护和监管需求、监管协同与司法互助三个层面采取应对措施。
With the globalization of the digital economy,the potential of digital RMB in cross-border payment scenarios is gradually becoming evident.However,the accompanying legal risks and conflicts are also increasingly prominent.The General Data Protection Regulation(GDPR),as one of the most stringent data protection laws globally,imposes high compliance requirements for cross-border data flows.The core principles and data subject rights protection rules of GDPR conflict to some extent with the technical characteristics and“controllable anonymity”mechanism of digital RMB.The regulatory uncertainties arising from different jurisdictions also pose challenges to the data compliance of digital RMB in cross-border payments.In response,measures can be taken from three levels:refinement of rules and institutional construction,technological innovation to balance data protection and regulatory needs,and regulatory coordination and judicial mutual assistance.
