摘要
历史城区凸显了历史文化名城的历史价值和城市文脉,是历史文化名城整体保护的关键。然而,目前历史城区法律制度缺失,保护管理机制尚不健全,导致诸多名城存在重视街区、忽视城区现象,不符合当前历史文化名城整体保护新理念新要求。以40座国家历史文化名城保护条例为样本,通过梳理分析各地条例中关于历史城区的相关条款,提炼历史城区整体保护的关键制度,提出立法建议,以期为历史城区相关立法工作提供参考。
The historic urban area highlights the historical value and the context of the historic city,which is the key to the integrity and real conservation of the historic city.Presently,however,the lack of the legal system of historic urban areas and the imperfect mechanism of conservation and management have led to the phenomenon that many historic cities attach importance to historic conservation areas but ignore historic urban areas,which does not meet the new concept and new requirements of the integrated protection of historic cities.This paper takes 40 historic city conservation regulations as a sample,trying to sort out and analyze the relevant provisions on historic urban areas in various regulations,extract key systems for the integrated protection of historic urban areas,and make legislative suggestions to provide reference for relevant legislative work of historic urban areas.
