摘要
数字行政检察是数字检察改革的重点与难点,数字行政检察在个案运用中呈现出“线索发现-数字赋能-类案监督”的样态,在试点推行中采用“1+N”的应用孵化方式与典型模型全域推广模式,其本质上是一种穿透式、类案式、一体化的新型行政检察监督。数字行政检察的发展具有必然性与必要性,但其发展存在隐忧,主要表现为:在制度维度,数字行政检察的改革重心与监督边界不清;在权力维度,数字技术赋能打破权力边界引发利益冲突;在技术维度,数字技术赋能带来潜在的公正遮蔽风险。未来,立足于实践,我们应将协作式法律监督作为数字行政检察的改革理念,推进其改革重心与监督边界之明确,推动不同国家机关之间联动以化解利益冲突,促进技术正当程序规制体系之构建。
Digital administrative inspection is the key and difficult point of digital inspection reform, the digital administrative inspection takes the form of“Clue discovery-digital empowerment-case supervision” in the application of cases, and adopts the“1 + N” applied incubation mode, in essence, it is a new type of penetrating, case-like and integrated administrative inspection. The development of digital administrative inspection is inevitable and necessary, but there are hidden worries in its development, which are mainly manifested in the following aspects: In the institutional dimension, the reform focus and supervision boundary of digital administrative inspection are not clear;In the dimension of power, digital technology can break the boundary of power and cause conflicts of interest;In the technological dimension, digital technology can bring the potential risk of fair shelter. In the future, based on the practice, we should take the cooperative legal supervision concept as the reform idea of digital administrative inspection, push forward the clear reform focus and supervision boundary, and push forward the linkage among departments to resolve the conflict of interests, to promote the construction of technical due process regulation system.
