摘要
对农村集体经济组织特别法人地位的理解,决定着其治理结构制度设计的基本走向。《农村集体经济组织法(草案)》中治理结构制度的路径依赖特征明显,但这种路径依赖并没有妥适考量农村集体经济组织特别法人地位的影响,以及中国式法治现代化道路供给的理论资源,从而导致制度设计的理念僵化、政策规定与试点经验的执行不力、方法论基础偏向个人主义等问题。据此,进一步分析与探讨《草案》中治理结构制度的完善路径,发挥党的领导、中国乡土文化的约束机制等中国式法治要素的力量,合理利用任意性规范的配置作用,在既定框架内妥适赋予农村集体经济组织法人关于治理结构模式、成员代表大会的设立、监督机构的设置等制度的选择权。
The understanding of the special legal person status of rural collective economic organizations determines the basic direction of the design of their governance structure system.The path-dependence of the governance structure system in the Draft Rural Collective Economic Organizations Law is obvious,but this path-dependence does not properly consider the impact of the special legal person status of rural collective economic organizations and the theoretical resources supplied by the Chinese-style road to rule of law modernization,which leads to the rigidity of the concept of institutional design,the ineffective implementation of policy provisions and pilot experiences,and the bias of the methodological foundation toward individualism.Accordingly,it is necessary to further analyze and explore the path of improving the governance structure system in the Draft,to bring into play the power of Chinese rule of law elements such as the Party’s leadership and the restraining mechanism of Chinese vernacular culture,to make reasonable use of the configuration of arbitrary norms,and to appropriately grant rural collective economic organization members the right to choose the governance structure model,the establishment of the representative assembly of members,and the setting of supervisory bodies within the established framework.
