摘要
正确适用赔礼道歉责任方式对于弘扬社会主义核心价值观、保障社会公众的精神利益、预防环境违法行为具有重要意义。通过对112份判决书的整体分析和典型个案的考察发现,当下赔礼道歉责任方式在环境民事公益诉讼裁判中的地位边缘化,责任认定随意,执行效果不佳。为此,人民法院应当科学运用赔礼道歉这一独特的责任方式,对案件充分释法说理,强化赔礼道歉责任方式对于弘扬社会主义核心价值观的重要作用。一方面,在裁判中统一说理逻辑与责任认定标准,对赔礼道歉责任方式的价值判断功能予以充分肯定。另一方面,在执行中充分发挥主观能动性,提升适用赔礼道歉责任方式的案件的社会关注度,充分发挥惩恶扬善、促进社会文明进步的积极作用。
The proper use of apology as a liability form is critical for promoting socialist core values,safeguarding the spiritual interests of the public,and preventing environmental violations.However,analysis of 112 judgments and typical cases shows that the liability form of apology is marginalized in environmental civil public interest litigation judgments,with arbitrary determination of liability and poor enforcement results.Therefore,the people’s court should scientifically apply the unique liability form of offering apology,fully interpret law and reasoning of the case,and strengthen the important role of apology in promoting socialist core values.For one thing,it is important to unify the reasoning logic and responsibility determination standards in judgments and strongly affirm the value judgment function of apology.For another,during the execution process,fully exert subjective initiative,enhance the social attention of cases that apply the liability form of apology,and give full play to the positive role of effectively punishing wrongdoing and promoting social progress.
