金融消费者权益保护与监管:因应、反思及体系重构 被引量:2

摘要 金融业的繁荣伴生交易结构呈现复杂化趋势,加剧了信息不对称、风险错配以及监管套利现象,随着民法理念与社会观念的转变,金融领域交易双方实然不平等的法律地位引起关注,而我国对于金融消费者权益保护与监管却存在上下位法冲突、行业之间分裂割据的问题。结合域外立法例及现实国情,对金融消费者保护体系的重构应当从监管规则、监管主体、监管手段与监管路径四个层面进行补足,以专门立法完善顶层设计,将穿透式思维贯彻金融监管与司法,秉持回应型法理念进行金融风险的预先防范和软法治理,并完善“内部投诉-非诉-诉讼”的多元化、多层次救济机制。 The prosperity of the financial industry is accompanied by a complicated transaction structure,which intensifies the phenomenon of information asymmetry,risk mismatch and regulatory arbitrage.With the change of civil law concepts and social concepts,the unequal legal status of the two parties involved in the financial field has attracted attention,while the protection and supervision of the rights and interests of financial consumers in China have conflicts of upper and lower laws and divisions between industries.Combined with foreign legislative examples and the actual national conditions,the reconstruction of the financial consumer protection system should be complemented from the four levels of regulatory rules,regulatory subjects,regulatory means and regulatory paths.We should use special legislation to improve the top-level design,implement financial supervision and justice with penetrative thinking,uphold the concept of responsive law to prevent financial risks in advance and soft law governance,and improve the diversified and multi-level relief mechanism of"internal complaint-non-litigation-litigation".
