摘要
破除“两权分置”下宅基地使用权身份性对财产性的束缚,释放宅基地要素价值,实现宅基地使用权的财产功能是宅基地“三权分置”改革的重要目标。适度放活宅基地使用权实质上就是要在宅基地配置与利用中适度引入市场机制,实现宅基地使用权市场化利用。确保宅基地“三权”的正当逻辑约束和宅基地制度保障功能实现是适度放活宅基地使用权的前提;完全按照私法逻辑构造宅基地使用权是适度放活宅基地使用权的逻辑起点。放活宅基地使用权之“适度”要求主要体现为体系限制和边界约束。宅基地使用权的适度放活应当坚持宅基地使用权财产化、利用主体市场化、利用方式多样化,从放活要求、放活条件、放活模式、放活方案等方面予以构造。
Breaking the shackles on the property content of identity requirements of traditional rural homestead use rights,releasing elements values of the rural homestead and realizing property values of the rural homestead use rights are important goals of the reform of the tripartite entitlement of the rural homestead systems.The essence of appropriate release of the rural homestead use rights is to appropriately introduce market mechanisms in the allocation and utilization of the rural homestead and to exercise the rural homestead use rights in accordance with the rules of the market.The premise of appropriate release of the rural homestead use rights is to coordinate the relationship with the other two rights and realize the guarantee function of the homestead systems.Constructing the rural homestead use rights in full accordance with the logic of private law is the basis for appropriate release of the rural homestead use rights.The"moderate"requirement for the revitalization of the rural homestead use rights is mainly reflected in system restrictions and boundary constraints.The rural homestead use rights in a moderate manner still faces systems restrictions of the rural homestead systems.The appropriate release of the rural homestead use rights shall adhere to the propertilization of the rural homestead use rights,the marketization of main entity of use,and the diversification of the utilization methods,and construct it from the aspects of the requirements for the rural homestead use rights,conditions for the release,modes of revitalization,and revitalization plans.
