摘要
当前,全球经济治理结构暴露出越来越多的缺陷,中国海外利益面临日益严峻的风险与挑战,但与之对应的海外利益保护法律体系并不完善。构建中国海外利益保护法律体系是一项历史性任务,需要夯实基础、立足长远。构建中国海外利益保护法律体系,需以人类命运共同体为指导理念,贯彻国际权力观、共同利益观、可持续发展观和全球治理观四个基本价值观;以法治、互利共赢、可持续发展、积极参与全球治理为基本原则;以统筹国际法治和国内法治,统筹立法、执法、司法、守法,统筹使用法律工具和非法律工具为基本路径。
The current global economic governance structure is showing defects that are posing increasing risks and challenges to China's overseas interests.In contrast to this,there is a lack of a salient legal system for protecting such interests.Thus building a legal system that will put China's overseas interests under its protection becomes a historic task.The task cannot be achieved without a solid foundation and long-term approach.A guiding notion for building such a system should be the building of a human community with a share future,with a thorough implementation of international rules regarding international power,common interests,sustainable development and global governance.The system should be based on the principles of rule of law,mutual benefit and win-win cooperation,sustainable development and active participation in global governance.To do this a basic approach is to integrate the use of of legal and non-legal tools in law-making,law enforcement,and law-abiding and by integrating international law with domestic law.
