摘要
我国《行政处罚法》修订后,新增的电子技术监控设备在行政化应用中存在着相关制度建设不完备以及与之配套的技术审核制度不健全的问题。现有的制度不能完全发挥效用,无法有效约束驱动电子技术监控设备运行的算法形成的新型权力。电子技术监控设备作为立法对技术进步范式转变的回应,它的规范应用,能够实现对技术渗透行政带来的结构转型的规范,调节因结构转型带来的利益冲突。为确保电子技术监控设备行政目标的实现,首先应以法律原则为指引夯实其合法性基础,提升法律体系的整体概观性;其次应规范算法授权、完善技术审核制度,增强法律体系兼容技术的自洽性;最后应强化对行政相对人的救济保障,突出以人为本的行政价值。
After the revision of the Administrative Penalty Law of China,some problems have appeared in the administrative use about the newly added electronic technology monitoring equipment,such as the incompleteness of the relevant system construction and the incompleteness of the supporting technical audit system.The existing system cannot fully play its role or effectively restrict the new power formed by the algorithm driving the operation of electronic technology monitoring equipment.As a legislative response to the paradigm shift of technological progress,the standardized administrative application of electronic technology monitoring equipment can standardize the structural transformation brought about by technology penetration administration and regulate the conflict of interest brought about by structural transformation.In order to ensure the realization of the administrative goal of electronic technology monitoring equipment,we should first consolidate its legitimacy foundation under the guidance of taking legal principles to enhance the integrity of the legal system.Secondly,we should standardize the algorithm authorization and improve the technical audit system to enhance the self-consistency of the legal system.Finally,we should strengthen the relief and guarantee of the administrative counterpart,so as to highlight the people-oriented administrative value.
