摘要
近年来,未成年人实施的恶性事件频现网络,引发社会广泛担忧,理论界和实务界对此兴起热议,罪错未成年人分级干预制度建设成为热点问题。我国现行法律将罪错行为分为不良行为、严重不良行为和犯罪行为三级,但因缺乏个体行为考量,划分标准和配套措施等方面无法满足实践需求。借鉴国外相关经验,结合我国国情,宜将罪错行为划分为不良行为、严重不良行为、触法行为和犯罪行为等四级,相应地建立层次分明、定位清晰并衔接紧密的罪错未成年人分级干预制度。
Malignant incidents committed by minors have frequently occurred on the internet in recent years,causing widespread concern in society and hot discussion in theoretical and practical circles.The construction of a grad-ed intervention system for juvenile offenders has become a hot issue.Current laws in China classify wrongful behaviors into three levels,that is,bad behavior,serious bad behavior,and criminal behavior.However,due to the lack of consideration for individual behavior,standards for classification,and corresponding measures,these classifications do not fully meet practical needs.Drawing on relevant foreign experience and taking into account national conditions in China,it is appropriate to divide wrongful behaviors into four levels,that is,bad behavior,serious bad behavior,be-havior that violates the law,and criminal behavior,and accordingly establish a graded intervention system for juvenile offenders that is clear in its hierarchy,location,and closely linked.
