摘要
新修订的《中华人民共和国预防未成年人犯罪法》实施以来,清远在罪错未成年人分级矫治方面进行了多项探索,如专门学校建设、“春风”系列行动、建立“1+8+N”工作体系等。然而,仍存在着罪错风险早期干预和低龄罪错行为矫治机制缺位、罪错行为分级模糊、矫治措施的选用和衔接不明等难题。本文以案例分析清远罪错未成年人分级干预矫治机制的需求,通过域外比较研究,探讨加强清远罪错未成年人分级干预矫治的对策。
Since the revision of the Law on the Prevention of Juvenile Crime,Qingyuan has carried out useful exploration of the graded correction of juveniles through the construction of specialised schools,the“Spring Breeze”series of governance actions,and the establishment of the“1+8+N”system.However,at the same time,there are practical dilemmas such as the lack of early intervention of the risk of guilt and the lack of correction mechanism for wrongful behaviour at a young age,the vague classification of wrongful behaviour and incomplete grading correction system,and the unclear selection and connection of corrective measures.Based on the response mechanism of the graded intervention and correction mechanism of juveniles in Qingyuan under the“risk-demand-response”model,through the extraterritory comparative research,the countermeasures to strengthen the graded intervention and correction of juvenile Delinquents in Qingyuan City are explored.
