“双碳”目标下绿色交通的法治保障研究 被引量:2

摘要 绿色交通是绿色发展理念在交通运输领域的集中体现,是推动“碳达峰、碳中和”目标实现的关键所在。绿色交通的发展有赖于社会主义法治体系的保障。但目前,我国绿色交通运输体系的构建在法治语境下存在如下问题:交通资源与交通环境领域存在立法缺陷;分散式交通行政执法体制弊端显露,并且交通行政执法的态度和方式亟待转型;司法能动理念和协同力度需进一步强化和提升。为此,完善公共交通立法以及《大气污染防治法》,建立综合性交通行政执法体制并推动交通执法态度和方式的转变,适度能动司法以及构建司法协同体系,方是推动面向“双碳”的绿色交通法治化进程的科学路径。 Green transportation is the concentrated expression of green development concept in the field of transportation.It is the key to promoting the realization of carbon peaking and carbon neutrality goals.The guarantee of socialist rule of law system is a necessary condition for the development of green transportation.However,there are problems on the construction of China's green transportation in the context of the rule of law at present.There are legislative shortcomings in China in the field of transportation resources and transportation environment.The shortcomings of the decentralized traffic administration and enforcement system have been revealed.And the attitude and way of traffic administrative law enforcement need to change with the times.The concept of judicial dynamism and synergy needs to be further strengthened and enhanced.To this end,we should improve public transportation legislation as well as the Air Pollution Control Act.We also should establish a comprehensive traffic administration and law enforcement system and promote the change of attitude and manner of traffic law enforcement.Last but not least,we would be moderately active in judicature and build a judicial coordination system.This is the scientific path to promote the rule of law process of green transportation for carbon peaking and carbon neutrality goals.
