摘要
【目的】集管组织从世界范围看既有自由竞争模式又有垄断法定模式,探索我国集管组织的模式选择与改革方向。【方法】以世界知识产权组织、学者和政府的意愿为基础揭示集管组织的非营利性组织初心。【结果】经比较发现自由竞争模式违背集管组织初心,垄断法定模式有利实现集管组织初心。我国集管组织独占垄断法定模式存在背离初心的可能和缺陷。【结论】我国集管组织改革方向是在《著作权法》框架下修改《著作权集体管理条例》,变独占垄断法定模式为寡头垄断法定模式。以集管组织寡头之间信用关系为基础建立寡头集管组织授权作品数据库统一对外许可机制。
[Purposes]From a global perspective,the centralized management organization has both a free competition mode and a monopoly legal mode.It′s necessary to explores the mode and the direction of the centralized management organization in China.[Methods]The original intent of the nonprofit orga⁃nization of the centralized management organization was revealed based on the desires of the World in⁃tellectual property Organization,scholars,and governments around the world.[Findings]By compari⁃son,the free mode of competition is found to violate the original intent of the centralized management organization,and the monopoly legal mode is beneficial for carrying out the original intent of the cen⁃tralized management organization.In our country,the legal mode of monopoly of collective management organizations has the potential and the defect of holding back the original intent.[Conclusions]The di⁃rection of the reform of collective management organizations in China is to amend the regulations on Col⁃lective Administration of Copyright under the framework of the Copyright Law and change the legal mode of exclusive monopoly to the legal mode of oligarch monopoly.According to the credit relationship among the oligarchs of the centralized managerial organization,it establishes the unified external licens⁃ing mechanism of the authorized works database of the centralized management organization of the oli⁃garchy.
