摘要
从《著作权集体管理条例》颁布以来,我国著作权集体管理领域出现的问题入手,比较了集体管理组织实行垄断模式与竞争模式的优劣。从三个方面分析了我国确立竞争性著作权集体管理模式的理由:人为地制造垄断不符合市场经济的自由竞争规律;竞争性的集体管理组织从根本上符合公众的利益;竞争性的集体管理组织有利于节约政府资源,减少行政部门的过度干涉。
Starting with problems in the field of copyright collective management in China Since the Copyright Collective Management Regulation promulgated, this paper compares the pros and cons between the monopolistic model of collective management organization and the competitive model, it analyzes the reasons for establishment of a competitive model of collective management of copyright in China from three aspects： to artificially create a monopoly does not comply with the rule of free competition in market economy; competitive and collective management organizations are fundamentally consistent with the public interest; competitive and collective management organizations can help to save government resources and reduce the excessive interference of administrative department.
