摘要
本文探讨功能性特征在我国专利侵权诉讼中的认定、保护范围的确定及侵权判定等问题。通过对涉及功能性特征专利进行情况分析,借鉴域外经验,结合我国司法实践,建议对功能性特征进行明确的界定和规制。首先,功能性特征的认定标准应进一步细化,根据专利产品类别进行划分,从正面认定及反面排除两方面明确功能性特征的内容。其次,应确定含有功能性特征专利的保护范围,明确恰当的实施方式。最后,细化功能性特征的侵权判定方法,增加指导案例供法官参考借鉴,从而更好地保护与规制权利要求中的功能性特征,解决我国相应的专利侵权纠纷。
This paper studies that patents with functional features have problems such as vague identification standards, difficulty in determining the protection scope and unclear judgment of infringement. By analyzing the situation of patents involving functional features, referring to foreign experience and combining with judicial practice in China, it is suggested to define and regulate functional features explicitly. First, it is that the criteria for identifying functional features should be further refined,including dividing different patent product categories, clarifying the content of functional features from positive identification and negative exclusion. Second, it is suitable to determine the protection scope of patents with functional features and clarify appropriate implementation methods. Third, refining the infringement judgment method of functional features, adding guiding cases for reference by judges. Aiming to protect and regulate the functional features better in the claims and solving the corresponding patent infringement disputes in China.
