摘要
黄河流域环境司法协同机制是推进黄河流域高质量发展的重要保障。流域环境司法理念的革新、黄河流域生态保护和高质量发展战略的阐发、破解行政区划与黄河流域生态系统割裂的弊端,共同构成了黄河流域环境司法协同机制的出场逻辑。在前述逻辑支撑下,黄河流域环境司法协同机制的地方实践探索也呈现出“多点开花”的特征,但同时也面临缺乏明确统一的法律依据、流域环境司法专门化效果不佳、预防性环境公益诉讼搁置与生态环境损害赔偿诉讼虚化等现实罅隙。需要从黄河流域的生态复杂性出发,遵循协同理论的要求,夯实黄河流域环境司法协同机制的立法基础、强化黄河流域环境司法专门化的程度、合理调整黄河流域环境司法行为方式。
The Yellow River Basin environmental judicial coordination mechanism is an important guarantee for promoting the high-quality development of the Yellow River Basin.The innovation of the concept of environmental justice in the river basin,the elucidation of the strategy of ecological protection and high-quality development in the Yellow River Basin,and the cracking of the shortcomings of the separation of administrative divisions and the ecosystem of the Yellow River Basin constitute the logic of the Yellow River Basin environmental judicial coordination mechanism.Under the support of the aforementioned logic,the local practice exploration of the environmental judicial coordination mechanism in the Yellow River Basin also shows the characteristics of"multi-point blooming",but at the same time,it also faces the lack of a clear and unified legal basis,the poor effect of the specialization of the environmental justice in the basin and its preventive effect.There are practical gaps such as the suspension of environmental public interest litigation and the virtualization of ecological environment damage compensation lawsuits.It is necessary to proceed from the ecological complexity of the Yellow River Basin,follow the requirements of the synergy theory,consolidate the legislative foundation of the Yellow River Basin environmental judicial coordination mechanism,strengthen the degree of specialization of the Yellow River Basin environmental justice,and reasonably adjust the Yellow River Basin environmental judicial behavior.
