摘要
大数据时代刑事犯罪愈加隐蔽化、高科技化,为大数据侦查的规模应用奠定了社会需求的土壤。而刑事司法的高度强制性注定了个人信息保护在大数据侦查中被忽视的局面。纵观侦查程序,这一现象出现的主要原因在于现行大数据侦查措施缺乏明确法律规定。个人信息权利已成为大数据时代人权保护的新面向,需要在厘清大数据侦查基本概念的基础上,建立整套规制手段,理念上融入合作治理机制,强调对个人的赋权,制度层面细化大数据侦查措施,以实现犯罪控制与公民个人信息保护的协调与平衡。
In the era of big data,criminal crimes are becoming more concealed and high-tech,which has laid a foundation for the large-scale application of big data investigations.The high degree of compulsion of criminal justice is doomed to the situation that personal information protection is neglected in big data investigation.Throughout the investigation procedure,the main reason for this phenomenon is the lack of clear legal provisions for the current big data investigation measures.As personal information rights become a new aspect of human rights protection in the era of big data,it is necessary to establish a complete set of regulatory means on the basis of clarifying the basic concepts of big data investigation,and integrate the concept of cooperative governance mechanisms,emphasizing the empowerment of individuals,and refining the system level.Big data investigation measures to achieve coordination and balance between crime control and protection of citizens'personal information.
