摘要
数字经济时代,算法推荐技术的应用降低了检索成本,契合用户需求,给公众的生活带来了极大的便利。与此同时,其不当应用也导致了人格权侵权、知识产权侵权,扰乱了市场竞争秩序,损害了消费者与劳动者合法权益。算法技术应用风险相较于传统法律风险,存在侵权主体特殊性、损害事实隐蔽性与侵权行为普遍性的特点,欧盟与美国据此都作出相应的立法尝试。为应对算法应用风险,应当规范平台义务,加强法治监管,促进协同治理,从而保障公民人身权利,维护市场经济秩序,保护消费者权益,维护劳动者保护体系。
In the era of digital economy,the application of algorithmic recommendation technology has reduced the cost of retrieval,fit the needs of users,and brought great convenience to the public life. At the same time,its improper application has also led to infringement of personality rights and intellectual property rights,disrupting the order of market competition and damaging the legitimate rights and interests of consumers and workers. Compared with traditional legal risks,the risk of algorithmtechnology application is characterized by the specificity of infringing subjects,the concealment of damage facts and the universality of infringing behaviors,according to which both the EU and the US have made corresponding legislative attempts. In order to deal with the risk of algorithm application,we should regulate the obligations of the platform,strengthen the rule of law supervision,and promote cooperative governance,so as to protect the personal rights of citizens,maintain the market economic order,strengthen the protection of consumer rights and interests,and maintain the protection system of workers.
