摘要
近几年来社会中主张数据权利的声音越来越大,但是我国当前并无法律直接规定数据权利,且学界对数据权利是新兴权利还是新型权利仍有较大争论。本文根据权利理论探明了数据权利是新兴权利,当前存在着数据权利体系不明晰、数据权利保护理论研究不完善、立法素材积累不足的缺陷,建议从司法、行政与立法保护这几条路径对数据权利进行渐进式保护。通过保护好这种新兴权利,促使其成为实在法上的权利,以此更好保障人权,护航好经济发展,在数字时代的国际竞争中抢占先机。
In recent years,the voice of advocating data right has become increasingly louder in the society,nevertheless,there is no law to directly stipulate data right in China and there is still a great debate in the academic circle on whether data right is an emerging right or new right.According to the right theory,this paper proves that the data right is an emerging right.The emerging right should be quickly responded by legislation.However,currently there are some defects,such as unclear data right system,imperfect theoretical research on data right protection and insufficient accumulation of legislative materials.Therefore,this paper proposes to protect data right gradually from judicial,administrative and legislative protection.By protecting this emerging right and promoting it to become a right in positive law,we can better protect human rights,safeguard economic development and enable the country to take the lead in the international competition in the digital age.
