矿业权“净矿”出让制度探索与实践研究——以山东省为例 被引量:5

Exploration and Practice Research on the “Net Mine” Transfer System of Mining Rights——Taking Shandong Province as an Example

摘要 "净矿"出让是我国矿业权出让制度的一项重大创新举措,结合国家矿产资源管理改革精神,通过总结山东省推进"净矿"出让试点工作的实践经验,分析"净矿"出让典型案例,阐述了关键环节和主要亮点,总结形成了"五个到位",即权属调查到位、政策服务到位、部门协同到位、交易程序到位、履职监管到位,初步提出了"净矿"出让制度模式,确定了主要工作流程,明确了"净矿"出让主要含义和具体标准,进一步丰富了"净矿"出让的内涵要义。 “Net mine”transfer is a major innovation of mining right transfer system in China. Combined with the spirit of national mineral resource management reform, the practical experiences of Shandong Province in promoting the pilot work of “net mine”transfer were summarized, the typical cases of “net mine”transfer were analyzed, and the key links and main highlights were expounded. Then,the principles of “five in place”were summarized, namely, ownership investigation in place, policy service in place, department coordination in place, transaction procedure in place, and performance supervision in place. The“net mine”transfer system model was initially put forward, the main workflow was determined, the main meaning and specific standards of “net mine” transfer were clarified, and the connotation of “net mine”transfer was further enriched.
