摘要
“双一流”建设的整体格局对法学人才的培养质量提出了更高要求,法科学生的毕业论文是人才培养与学术创新的重要内容呈现。现有的法学毕业论文指导模式存在“形式化”与“结果论”的误区,其也背负着与之并不协调的功能承载与额外负担。与此相对应,结合法学专业的学科特色以及“本硕博”三阶段的不同培养侧重,转换传统的思维窠臼。改变现有“结果论”的指导重心,回归针对性更强的“过程管理”为中心的指导模式。通过将“形式化的静态质量强调”和“实质化的动态管理指导”作为卓越法治人才培养有效性的综合标准,构建覆盖法学毕业论文指导全过程的规范评价体系。
The overall structure of "Double-First Class" Project puts forward higher requirements for the cultivation quality of legal talent.Law majors’ graduation theses is an important presentation of talent cultivation and academic innovation.The existing legal graduation thesis supervising model holds the misunderstanding of "formalization" and "resultorientation".It also bears the unbalanced function bearing and additional burden in legal education.Correspondingly,this paper suggests that the improvement of law majors’ graduation theses should combine the disciplinary characteristics of the major,consider the education focuses on different degrees of " Bachelor,Master,and Doctor" and transform the limitations of traditional education thinking pattern.This paper also suggests to change the result-oriented supervision model and return to the process management-centered supervision model.In this way,the " substantive dynamic management supervision model" can be integrated into the "formalized static quality-orientation supervision model".With these measures,a standard evaluation system that covers the whole process of law majors’ graduation theses will be established according to the feasible and comprehensive standard for the cultivation outstanding legal talent.
