摘要
监狱巡回检察改革实际上构建了“派驻+巡回”的检察模式,这一结合检察模式并非“派驻”和“巡回”两种检察模式的机械嫁接,而是彼此相互融合优化,积累了实践的和体制机制的经验。看守所作为监管场所之一,在明晰其与监狱在监管对象、法定职能、检察监督内容、机构设置等方面存有差异的基础上,发掘其仍具备进行检察改革的法律基础和现实需要。顺应建立统一的刑罚执行体系之趋势,看守所检察模式构建应考虑将重心放在对未决羁押职能检察上,保留派驻检察以应对人员流动较大、羁押必要性检察、重大案件讯问合法性检察以及其他时效性、全程性工作开展的需要;变补充巡回检察为常态化巡回检察,用以消解驻所检察人员被同化等问题。从检察方式、检察组建立、检察工作内容、检察结果与救济等方面设计看守所检察思路,形成区别于监狱并保障诉讼权利的检察规则。
The reformation of touring procuratorial in detention center has constructed the mode of“stationed procuratorial supervision+touring procuratorial supervision”,and this combined mode is not a mechanical grafting of the two separate modes,but a mutual integration and optimization,which accumulates practical and institutional experience.The detention center,as one of the places of supervision,on the basis of clarifying the differences from the prison in terms of objects of supervision,statutory functions,contents of procuratorial supervision and institution setting,still has the legal basis and practical needs for procuratorial reform.With the trend of establishing a unified penalty execution system,the construction of procuratorial mode in detention center should focus on the procuratorial function of pending detention,and keep the stationed procuratorial supervision to deal with the needs of large turnover of personnel,the procuratorial legality of detention,the procuratorial legality of interrogation of major cases,and other timely and whole-process work.To change the supplementary touring procuratorial supervision into the regular touring procuratorial supervision is in order to solve the problems of the assimilation.This paper tries to design a set of procuratorial thoughts from the aspects of procuratorial methods,establishment of procuratorial team,content of procuratorial work,procuratorial result and remedies.It provides reference for the formation of prosecutorial rules which are different from prison and protect litigation rights.
