摘要
传统的监狱检察实行"派驻检察"模式,其常态进驻的运行机制建立在便利监督的理论基础之上,因独立性不足而面临着检察质效不佳的现实困境。以问题为导向,最高人民检察院启动了改"派驻"为"巡回"的试点,以"独立监督"为理论基础的"巡回检察"模式,面临着改革成本与成效的双重质疑。试点地区将传统经验与试点方案结合起来,选择了"派驻+巡回"的新模式。三种监督形态下,监狱检察也得以从形式层面进入到了强调有效检察的实质层面。以监狱检察的三种模式勾勒出来的监狱检察制度的改革之路,呈现出现阶段更加理性、务实的改革观。
The traditional procuratorial supervision for prison implements the"stationed procuratorial supervision"model. The model operates its mechanism based on the theory of facilitating supervision,and is facing practical problems of poor quality and effect due to the lack of independence. Problemoriented,the highest procuratorial organ launched a pilot project to change the"stationed"into"touring",and base the "touring procuratorial supervision"model on the theory of independent supervision. Such reform is facing doubts on both the cost and the effect. In reply for this,the pilot practice combines the traditional experience with the pilot scheme,and establishes a new"stationed+touring"model. The three forms of procuratorial supervision all managed to enter the substantive level of the effective supervision. The reform path of the procuratorial supervision for prison outlined by the three models presents a more rational and pragmatic reform concept at the present stage.
