摘要
在生态文明体系建设和经济社会发展全面绿色转型的背景下,我国的乡村振兴是经济、社会、生态等全方位的振兴。生态化发展是生态保护与经济发展的统一,是发挥乡村生态资源优势和提升环境生产力的重要选择。当前我国乡村生态化发展面临着激励机制不足、治理机制不健全和工业环境侵权救济机制不完善等体制机制挑战,迫切要求加强生态化发展法治建设,以经济激励措施调节乡村发展行为,以多元共治模式提升治理效能,以严厉措施提高农村环境违法成本,以环境污染受害者援助机制增强法的实效,从而确保乡村振兴遵循生态化、可持续的发展路径,实现农业农村生态现代化,进而实现乡村全面振兴。
In the background of ecological civilization system construction and comprehensive green transition of economic and social development,China’s rural revitalization means an all-round revitalization of economy,society and ecology.Ecological development is the unity of ecological protection and economic development,and an important choice to give play to the advantages of rural ecological resources and the improvement of environmental productivity.At present,there are some institutional challenges such as insufficient incentive mechanism,imperfect governance mechanism and lack of relief mechanisms for industrial environmental torts,so that it is urgent to strengthen the construction of the rule of law for ecological development,including adjusting rural development behavior with economic incentives,improving governance efficiency with multiple co-governance models,increasing the cost of rural environmental violations with severe measures,and enhancing the effectiveness of the law with assistance mechanisms for victims of environmental pollution,so as to secure that the rural revitalization follows the ecological and sustainable development path,realize the agricultural and rural ecological modernization,and then realize the rural revitalization in an all-round way.
