摘要
在介绍消防行政自由裁量权的基础上,基于AHP-模糊综合评价法,建立消防行政自由裁量权的数学评判模型,以行政处罚中罚款为例,对违法情节、场所类型、场所规模、违法历史、违法动机等多评价指标进行考量,结合集体议案,作出合理的处罚结果,以有效防止因主观或单因素评判造成的执法不公现象,实现自由裁量合理性规制及量化,为实现消防行政处罚的智能裁量提供思路。
This paper studies fire administrative discretion and proposes setting up a mathematical evaluation model based on AHP-fuzzy comprehensive evaluation method.Administrative penalty is used in this paper to demonstrate the indicators taken into consideration in the multiple evaluation model,ranging from violation circumstance,location,scale of the location,violation records to motive behind violation.Collective case review will be conducted to make a reasonable decision on penalty in order to prevent effectively the injustice in law enforcement,which may be caused by subjective or single-factor judgement and achieve quantification and rational regulation of discretion,providing reference for the intelligent judgement of fire administrative penalty.
