摘要
旅游市场综合监管在"全域旅游"这一国家战略的推动下对于市场乱象的整治、旅游环境的改善发挥了一定的作用。但传统的政府综合监管模式因缺乏协同性、整体性和系统性而难以应对层见叠出的旅游纠纷。有鉴于此,本文立足于国家治理现代化框架下"创新社会治理体制"的理念更新和规范调整,检视了现行旅游市场综合监管机制在立法、执法、司法、行业等方面的不足,引入协同治理思想形成政府、司法、行业、公众、社会多方共治的新时期治理模式,找准协同治理的最大公约数、最佳连接点,本土化建构旅游市场综合监管新模式以发挥内外部多元化模式协同效能与效度,助力旅游市场综合监管多方面、多层次的深度融合,积聚各部门优势推动协同治理的实现。
Comprehensive supervision of tourism market has played a role in the improvement of market disorder and tourism environment under the promotion of the national strategy of holistic tourism destinations.However,from the perspective of practical operation,it is difficult for the traditional government management mode to form a comprehensive supervisory mechanism with synergy,integrity and systematicness,and to effectively deal with complicated tourism disputes.Thus,based on the modernization of the national governance under the conceptual framework of“the innovation of social management system”to update and adjust specifications,this paper examines the current comprehensive regulatory mechanism of tourism market in such aspects as legislation,law enforcement,judicature,and judicial departments,and adopts the collaborative management thought to form a new multi-lateral model in the new period in order to solve the problems of departmentalization,fragmentation and decentralization under the traditional management model,and to overcome the bottleneck of the current model of tourism market.
