摘要
人工智能(AI)诊疗过程中存在着治疗风险、隐私泄露及不被患者接受等伦理问题。针对AI辅助诊疗过程中的意外所引发的责任划定问题,目前还缺乏结合临床实际、伦理及与法规三位一体的探讨。医疗领域机器人可以分为低级的辅助性机器人和高级的机器人医生,机器人的不同类型决定了医生责任程度的差别。此外,医疗机构需要根据机构伦理、制度流程等方面的过失承担相应责任;AI厂家也应对机器人产品承担质量保障、网络安全维护和患者隐私保密的责任。
In the process of artificial intelligence(AI)assisted diagnosis and treatment,there are ethical problems such as treatment risks,privacy disclosure and not being accepted by patients.As for the problem of responsibility demarcation caused by accidents in the process of AI-assisted diagnosis and treatment,there is still a lack of discussion on the trinity of clinical practice,ethics and regulations.Robots in the medical field can be divided into low-level auxiliary robots and high-level robot doctors.Different types of robots determine the difference in the degree of doctors’responsibilities.In addition,medical institutions should take corresponding responsibilities according to the institutional ethics,system and process,etc.AI manufacturers should also be responsible for quality assurance,network security maintenance and patient privacy.
