摘要
新业态从业者鲜有工伤保险。吴江灵活就业人员职业伤害保险试点反证了新业态下劳动关系立法的必要性。浙江省适时制定职业伤害保险地方法规,明确平台企业基于非从属性排除的为从业者缴纳职业伤害保险费的义务、无用人单位及自雇的劳动者自主参保等事宜,以无缝衔接工伤保险,在立法上具合法性,于内容上也具合理性。
New business workers seldom have work-related injury insurance.The necessity of labor relations legislation under the new business type is proved by the pilot of flexible employment personnel occupational injury insurance in Wujiang.Zhejiang Province formulates local regulation of occupational injury insurance in due time to clarify the obligations of platform enterprises to pay occupational injury insurance premium for workers based on non subordination exclusion,no-employer or self-employed workers’participating in insurance independently,etc.,so as to seamlessly link work-related injury insurance,which is legal in legislation and reasonable in content.
