摘要
环境风险在不同时空存在显著的差异,使得以时空为依据和范畴进行环境风险规制研究的必要性凸显。区域环境风险可以被视为不同类型的环境风险因子叠加和互相作用形成的风险群。环境规制存在区域异质的特点,区域环境风险规制对象极具特殊性,因此环境规制是区域环境风险管控的基本工具。区域环境风险法律规制目标是预防区域环境风险发生,维护区域和国家生态安全,减免区域环境风险所致损害和维护区域环境质量。区域环境风险规制的基本进路是实施区域环境空间管控和区域环境协同治理。完备的区域环境风险法律规制体系包括贯彻“事前严防”理念的区域环境风险评估制度和区域环境风险预警制度,贯彻“事中严管”理念的区域环境事件应急制度,以及区域环境风险“事后处置”制度。为了保障上述基本制度得到恰当实施,还应当加强区域风险防控基础能力建设。
Environmental risks vary in different temporal and spatial context.The characteristics of environmental risk highlight the importance and necessity of the research of environmental risks in different temporal and spatial context.Regional environmental risk can be defined as a cluster of environmental risks caused by the interaction and multiplicity of diverse types of environmental risks.Environmental risks are related to different temporal and spatial contexts,and the object of regional environmental risk regulation has its unique characteristics so that legal regulations become the basic proper means of regional environmental risk management.The goal of regional environmental risk regulation is to prevent regional environmental risk,safeguard regional and national ecological security,and maintain regional environmental quality.The primary approaches of regional environmental risk regulations are to implement environmental space management and regional environmental collaborative governance.Complete systems of regional environmental risk regulation consist of regional environmental risk evaluation,regional environmental risk precaution,regional environmental risk emergency management,and regional environmental risk afterwards treatment.Meanwhile,in order to guarantee the implementation of above systems,the regional environmental risk infrastructure should be developed.
