摘要
中国是文化遗产大国,却称不上文化遗产保护强国,无论在保护范围、保护方式、保护力度上,还是在立法体系、制度设计、思维理念等方面都存在不少问题,尤其是"公众参与"这一国际社会普遍适用的文化遗产保护机制迟迟不能落实,使得相关工作不仅无法有效吸纳社会资源的加入,而且也减损了外部监督的力量。随着公益诉讼制度尤其是检察机关提起公益诉讼制度的逐渐成熟,公众参与文化遗产保护有了一条较为可行的进路,但仍有许多立法上的细节问题需要厘清。
China is abundant in cultural relic both on the numbers and kinds in the world. However, incon-sistent with the status of this cultural heritage power, China is far from protecting the cultural heritage well, nomatter on prot’ection range, protection strength, or legislative system, system design and thinking concept. Espe-cially, we dont absorb the public participation which is widely used on the world into our cultural heritage pro-tect’ion system. With the development of the public interest litigation, especially the system of the procurator-ates filing of public interest litigations, there is a feasible way on how the public participate in the cultural heri-tage protection. In the meantime, there are still some legislative details to make clear.
